Marijuana Use Restrictions in Colorado

Prior to entering law school, Jacob Scholl served as the chief marketing officer for a marijuana paraphernalia company based in Boulder, Colorado. Since graduating from the Sturm College of Law, Jacob Scholl maintains an interest in the state’s marijuana laws.

When Colorado legalized recreational marijuana use in 2012, it was one of the first states to do so. However, there are still restrictions in place on how and where marijuana can be consumed. For example, in circumstances where federal law overrides state law, such as on federal land or the behavior of non-US citizens, marijuana use is still illegal. It is also illegal to transport marijuana across state lines. Within Colorado, no one may sell marijuana without a license.

Youth under 21 years old are also prohibited from purchasing or consuming any type of marijuana products. Due to strict driving-under-the-influence laws, Colorado does not allow the transport of open marijuana containers in motor vehicles. Possession limits vary based on the individual’s circumstances. People who hold medical marijuana cards can purchase up to 2 ounces in a single transaction, while recreational users are limited to 1 ounce.
